Mann, Wyatt & Rice Midwest Attorney Mike Wyatt

As the home to more than 2 million people, Kansas City residents in Kansas and Missouri could be at an increased risk of suffering a personal injury. If you’ve experienced a personal injury in the Kansas City area— from a traffic accident to a workplace injury— you may be wondering if there are time limits for filing a personal injury claim?

According to personal injury attorney, Mike Wyatt of the Mann, Wyatt & Rice Midwest Injury Firm, time limits for filing a personal injury claim depend on the state. The time limit is also referred to as the statute of limitations, which is defined as a period of limitation for bringing legal action.

Because Kansas City straddles the border between Kansas and Missouri, it’s helpful for city residents to be aware of time limits in both states as outlined below. The time “begins” at the date of injury.

Kansas Time Limits for Filing a Claim

  • Two year time limit for filing a personal injury claim
  • Two year time limit for filing a wrongful death claim

Missouri Time Limits for Filing a Claim

  • Three year time limit for filing a personal injury claimFive
  • Five year time limit for filing a wrongful death claim

“There is a concept called the statute of repose,” said Wyatt. “If there’s some reason you couldn’t have brought the claim within the statute of limitations, you may still bring the claim within the statute of repose if it meets the exceptions.”
